TERMS AND CONDITIONS
The launch of Nokia Lumia at Pavilion KL (hereinafter referred to as the “Event”) is organised by Nokia (M) Sdn Bhd (hereinafter referred to as the “Promoter”). Participation in this Event is deemed acceptance of these Terms and Conditions.
1. Event Details
Date of Event: Friday, 10 February 2012
Time: 5.30pm
Venue: Pavilion KL (next to La Bodega)
2. Exclusive offer at the Event
2.1 Each of the first 100 Nokia Lumia 800 purchasers at the Event will be entitled to the following worth up to RM1,000:
(i) Nokia Purity HD Stereo Headset by Monster WH-930 (RRP: RM798);
(ii) Microsoft Arc™ Touch Mouse (RRP: 199); and
(iii) Exclusive Nokia Premium
2.2 The Nokia Lumia 800 will be sold by the Promoter’s official dealer at the Event venue at the Event date and time specified above.
2.3 Participants must be 18 years old and above as of the date of Event date. Participants under the age of twenty-one (21) years old must seek parental and/or guardian consent before participating in the Event.
2.4 Participants will be required to queue at the Event venue and the offer is valid strictly on a “first come, first serve” basis. Participants will be required to follow the instructions of the Promoter in the event that they wish to take short breaks from the queue, failing which the participant’s place in the queue will be forfeited.
2.5 Participants must show their official wristband (to be given out at the Event) to be eligible for the purchase. No purchase will be allowed without one.
2.6 Only one purchase per person will be allowed.
2.7 Purchasers will be required to pay the full price of the Nokia Lumia 800, as advised by the Promoter during the Event.
2.8 Only Visa, MasterCard or American Express credit card or cash will be accepted. Credit Card purchasers are required to present their identification document in the form of driver’s license, IC or passport for verification purposes.
2.9 The availability of the phone colours and the free promotional items are on a while stocks last basis. The Promoter cannot guarantee that all colours will be available at purchase
2.10 The phones are sold without contract with any operator.
2.11 Nokia Lumia 800 utilises a “micro-SIM”. If purchasers do not have a micro-SIM, they may obtain one from their preferred operator.
3. General
The Promoter’s decision is final and no correspondence will be entered into.
The Promoter reserves the right, at any time, to verify the eligibility of participants (including a participant’s identity, age and place of residence) and to disqualify any participant whose purchase is not in accordance with these terms and conditions or who tampers with the purchase eligibility process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter may, at any time in its sole discretion and without prior notice, vary, modify, delete or add to these terms and conditions and may also withdraw or discontinue the Event at any time without any notice or liability to any participant.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury and damage to personal property, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising out of or in connection with the Event, including, but not limited to (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in the value of the promotional gift to that stated in these terms and conditions; (d) any tax liability incurred by a participant.
Personal information will be collected at the Event in order to conduct the Event and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, suppliers and, as required, to the relevant authorities. The personal information may be transferred across international borders to server locations overseas. By providing the required information, you consent to the use of the information in accordance with the Event terms and conditions. The Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participants. Participants should direct any request to access, update or correct information to the Promoter. The personal information collected from the Event will be processed according to the Nokia Privacy Policy which forms part of the terms and conditions of the Event. All entries become the property of the Promoter.
Participants are solely responsible for all charges incurred in participating in the Event, including any transportation charges, internet, mobile phone charges and/or SMS charges, as may be applicable.
In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Event, these terms and conditions will prevail.
